1. Acceptance of Terms

By downloading, installing, or using the Alera mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Alera ("we", "us", or "our"). Please read them carefully.

2. Description of Service

Alera is a personal migraine tracking application that allows users to log migraine attacks, record potential triggers, view historical data, and identify patterns in their migraine occurrences over time. The App is available on Apple iOS devices.

Core features include:

• Migraine event logging (intensity, duration, symptoms)
• Trigger tracking (user-defined and preset categories including sleep, stress, food, and weather)
• Timeline and calendar history views
• Basic analytics covering frequency and trend data
• Account authentication via Apple Sign-In
• Subscription management via RevenueCat

Some features require a paid subscription. Free-tier limitations are displayed within the App and are subject to change with notice.

3. Eligibility

You must be at least 13 years of age to use Alera. If you are under 18, you must have the consent of a parent or legal guardian to use the App. By using Alera, you represent and warrant that you meet these age requirements.

Alera is designed for personal, non-commercial use. Use of the App on behalf of a third party without their knowledge or consent is not permitted.

4. Your Account

Account creation

Alera uses Apple Sign-In as its primary authentication method. By signing in, you authorise Alera to access the basic profile information provided by Apple as part of that authentication process. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

Account security

You agree to notify us immediately if you suspect any unauthorised use of your account. We cannot and will not be liable for any loss or damage arising from your failure to maintain account security.

Account deletion

You may delete your account at any time from within the App settings. Upon deletion, your personal data will be removed from our systems within 30 days, subject to any retention obligations described in our Privacy Policy.

5. Subscriptions & Billing

Free tier

Alera offers a free tier with limited functionality. Free-tier limits may be updated over time; we will communicate material changes within the App.

Paid subscriptions

Premium features are available through auto-renewing subscriptions managed via RevenueCat and billed through the Apple App Store. By purchasing a subscription, you agree to Apple's payment terms and authorise recurring billing at the stated interval until you cancel.

Pricing

Current pricing is displayed in the App at the point of purchase. Prices may vary by region and are subject to applicable taxes. We reserve the right to change pricing with reasonable notice before any new billing cycle.

Cancellation and refunds

You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period. Refunds are subject to Apple's refund policy; Alera does not directly control App Store refund decisions.

Free trials

Where a free trial is offered, it will be stated clearly at the point of sign-up. At the end of the trial period, your subscription will automatically convert to a paid plan unless cancelled before the trial ends.

6. Acceptable Use

You agree to use Alera only for lawful purposes and in accordance with these Terms. You must not:

• Use the App in any way that violates applicable local, national, or international law or regulation
• Attempt to gain unauthorised access to any part of the App, its servers, or any connected systems
• Reverse-engineer, decompile, or disassemble any part of the App
• Use automated tools, bots, or scrapers to access or interact with the App
• Upload or transmit any content that is harmful, offensive, or infringes the rights of others
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Attempt to interfere with the proper working of the App or disrupt other users' access

Violation of these rules may result in immediate suspension or termination of your account.

7. Health Disclaimer

Alera is not a medical device and has not been evaluated or approved by any healthcare regulatory authority. Nothing in the App constitutes medical advice, diagnosis, or treatment.

Always consult a qualified physician, neurologist, or other licensed healthcare provider regarding any medical condition, symptoms, or treatment options. Do not disregard or delay seeking professional medical advice based on information provided by the App.

In the event of a medical emergency, contact your local emergency services immediately. Do not use the App as a substitute for emergency medical care.

8. Intellectual Property

The Alera App, including its design, code, graphics, text, and all other content, is owned by Alera and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of any personal data you input into the App. By using the App, you grant us the rights necessary to store, process, and display that data as described in our Privacy Policy.

You may not copy, reproduce, distribute, publish, or create derivative works based on any part of the App without our prior written permission.

9. Your Data

Your use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using Alera, you consent to the collection, processing, and storage of your data as described in that document.

You are responsible for the accuracy of the data you enter. We do not verify the accuracy of user-entered health data and accept no liability for decisions made based on inaccurate records.

10. Termination

We reserve the right to suspend or terminate your access to Alera at any time, with or without notice, if we reasonably believe you have violated these Terms or if we are required to do so by law.

You may stop using the App at any time. Termination of your account does not entitle you to a refund of any prepaid subscription fees, except where required by applicable law.

Upon termination, provisions of these Terms that by their nature should survive will remain in effect, including sections on intellectual property, health disclaimers, limitation of liability, and governing law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Alera and its developers, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or related to your use of the App.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components. We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice or liability.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damage. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where the changes are material, notify you via the App or by email.

Continued use of Alera after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Alera is registered, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in that jurisdiction, unless otherwise required by applicable consumer protection laws in your region.
